Terms of Service

The main agreement for using Overlays.me, including accounts, streaming, overlays, subscriptions and platform rules.

1. Eligibility

You must be at least 13 years old to use Overlays.me. If you are under 18, you must have permission from a parent or legal guardian. You must not use the Service if you are legally prohibited from doing so.

2. Accounts and Security

You are responsible for your login details, account activity, profile information and any content submitted from your account. You must not impersonate another person, create accounts to evade enforcement, sell accounts without permission or use automated account creation tools.

3. The Service

Overlays.me may provide live streaming, chat, overlay creation, overlay hosting, subscriptions, creator pages, digital assets, community features, moderation tools and future premium services. Features may be changed, suspended or removed where needed to operate or protect the platform.

4. User Content Licence

You retain ownership of your content. By uploading, streaming or sharing content, you grant Overlays.me a worldwide, non-exclusive, royalty-free licence to host, display, transmit, cache, back up, moderate and promote your public content as needed to provide the Service.

5. Creator Responsibilities

Creators are responsible for all content broadcast from their channels. Creators must ensure they have the rights to stream games, music, video, software, artwork, overlays, images, sponsorship material and third-party content.

6. Community Rules

You must not use Overlays.me to create, upload, stream, promote or distribute content that is pornographic, sexually explicit, racist, hateful, abusive, illegal, fraudulent, malicious, exploitative, threatening or otherwise unsafe.

Zero tolerance: Overlays.me does not allow child sexual abuse material, terrorism-related content, racism, hate speech, non-consensual intimate content, grooming, credible threats, malware or illegal activity.

7. Live Streaming and Chat

Streams and chat may be moderated, logged, reviewed, interrupted or removed where required for safety, legal compliance, copyright, platform integrity or enforcement. Chat messages may be public and may be retained as part of moderation history.

8. Subscriptions and Payments

Subscriptions may renew automatically unless cancelled. Fees are billed in advance. Benefits may vary by creator or tier. Unless required by law, payments are generally non-refundable after access to digital benefits has started. Payment providers may apply their own terms.

9. Taxes and Creator Income

Creators are responsible for declaring and paying taxes due on income earned through Overlays.me. Overlays.me may withhold, delay or reverse payments where required by law, payment-provider rules, fraud checks, chargebacks or sanctions compliance.

10. Digital Goods

Overlays, templates, badges, assets and other digital goods are normally licensed rather than sold. Buying access does not transfer intellectual property ownership unless expressly stated in writing.

11. Intellectual Property

Overlays.me branding, software, design, systems, databases and platform technology belong to Overlays.me or its licensors. You must not copy, reverse engineer, scrape, resell, misuse or reproduce substantial parts of the platform without permission.

12. Copyright

We may remove allegedly infringing content and may terminate repeat infringers. Use the Copyright Policy for notices, evidence and counter-notices.

13. Moderation and Enforcement

We may warn, restrict, timeout, suspend, ban, demonetise, remove content, reduce visibility or terminate access where we believe these Terms or our policies have been breached.

14. Availability and Changes

The Service is provided on an as-is and as-available basis. Maintenance, outages, upgrades, attacks, provider issues or operational needs may affect availability.

15. Liability

To the fullest extent permitted by law, Overlays.me is not liable for indirect loss, lost profits, loss of business, loss of data, reputational loss or service interruption. Nothing limits liability that cannot legally be excluded.

16. Governing Law

These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have jurisdiction unless applicable consumer law provides otherwise.
